UP Tightens Marriage Registration Rules: Stricter Guidelines for Couples Without Family Consent

New Guidelines in Response to High Court Ruling

The Uttar Pradesh government has implemented stricter rules for marriage registration, especially in cases where couples marry without family approval. This move follows a recent decision by the Allahabad High Court. It prompted the Yogi Adityanath administration to issue an official order. The aim is to ensure more transparency and reduce fraudulent marriages.

Mandatory Presence of Family Members

Under the new rules, at least one family member must be present during the marriage registration process. This family member can be a parent, sibling, grandparent, or an adult child. This regulation aims to prevent cases of deception and impersonation, which have reportedly increased in areas like Ghaziabad.

According to a circular issued by the Inspector General of Stamp and Registration, family presence will be strictly monitored. Local sub-registrars have been directed to implement these changes effectively.

Additional Requirements for Marriages Without Parental Consent

For couples choosing to marry without family approval, additional layers of verification have been introduced:

• An affidavit from the officiant (priest, qazi, pastor, etc.) who conducted the marriage is now required.
• The officiant may also be summoned to testify before the registration officer if needed.
• A complete video recording of the marriage ceremony must be submitted in a pen drive during registration.
• A special stamp will be added to the marriage certificate to indicate that all verification steps were completed.

These measures aim to discourage misuse of unrecognized institutions. Unauthorized Arya Samaj temples have been accused of performing marriages under false pretenses. In Ghaziabad alone, five such cases were reported last year.

Registration Limited to Permanent Residential Districts

Another key provision under the new system is that marriage registration must now take place in the district. It should be where either the bride’s or groom’s family resides permanently. According to Ghaziabad sub-registrar Rahul Shukla, this step is intended to prevent jurisdictional loopholes and further strengthen the oversight process.

Notices outlining these rules have been posted at registration offices. A special register will be maintained to record details of such marriages.

Background: Court Cases Prompt Reform

The policy change was largely influenced by legal cases like “Shanidev vs. State of Uttar Pradesh,” in which couples eloped and married without parental consent. According to the court, over 150 such cases have surfaced recently, prompting the need for regulatory reforms.

The new rules mark a significant shift. They position marriage not just as a union of two individuals. It is also an event requiring accountability from both families and the state. Officials believe the updated procedures will make the process more transparent, reliable, and resistant to abuse.
