India’s Gaming Sector Cheers New Bill as Government Bans Real-Money Games, Boosts eSports

The Rajya Sabha on Thursday passed the Promotion and Regulation of Online Gaming Bill. Opposition leaders in the House protested the bill. Despite the uproar, the legislation was cleared through a voice vote.

Deputy Chairman Harivansh announced the approval of the legislation in the Upper House and subsequently adjourned proceedings for ten minutes.

Bill was passed in Lok Sabha on Wednesday “The promotion and regulation of online Gaming bill, 2025”. It gives a boost and official support to esports gaming. However, it prohibits online money games. The regulatory authorities are formalized to look into various arenas of online gaming. 

The Bill passed aims to promote and regulate eSports, educational, and social games. It completely prohibits the offering, operation, facilitation, advertisement, promotion, and participation in online money games.

The New Bill Stance

The newly proposed legislation talks about the creation of a central regulatory body. This body will oversee four key areas in this domain. These areas include eSports, educational games, social games, and real money making. 

The Bill’s “Prohibitions” clause states: “No person shall offer, aid, or abet online money games. No individual shall induce or engage in the offering of online money gaming services.” It further refrains banks and financial institutions from processing transactions for such platforms.

Under the “Offences and Penalties” clause, service providers found offering real money games could face up to three years’ imprisonment. They could also face fines of up to Rs 1 crore.

Advertisement of such money games is not allowed. The punishment declared for committers of the crime includes a fine up to 50 lakhs. It also includes up to 2 years of imprisonment. 

The government defended the move. They cited widespread social and financial harms: “The proliferation of online money games offers monetary returns against user deposits. This trend has led to serious social, financial, psychological, and public health harms. These issues are particularly severe among young individuals and economically disadvantaged groups.”

eSports and Online Money Games

The Bill clearly defines the differentiating lines between different types of e-Games.

The Bill defines eSports as the game played by several players in the multi-player mode. eSports involves organized competitive competitions played between Individuals or teams. The games are played in multi-player format. They follow predefined rules and are recognized under the National Sports Governance Act, 2025. 

Online money gaming apps on the other side are defined by the bill as games played online. These games are based on skill, chance, or both. A user pays fees, deposits money, or stakes something with the expectation of winning monetary or other rewards. Importantly, this definition does not include eSports.

Clearly distinguishing eSports from online money games and gambling is crucial. It provides the legal recognition and legitimacy that athletes, creators, and gaming organizations have long awaited. With the support of the government, players and creators can now pursue eSports professionally with confidence.

By providing clear definitions, it safeguards the interests of players and creators. It promotes skill-based competition and supports the ecosystem. This strengthens India’s position as a leading name in the online gaming market in the world order.
