Shifting Narrative and Complexities in Murder of Nikki Bhati

Disturbing details and triggering visuals from the dowry death case of Uttar Pradesh’s Greater Noida have sparked massive outrage, with growing calls for justice for 28-year-old Nikki Bhati, who was allegedly set ablaze by her husband and in-laws on August 21.

Four people have been arrested so far in connection with the case. These people are Nikki Bhati’s husband, mother-in-law, father-in-law, and brother-in-law. Her brother-in-law was married to her own sister.

The Initial Narrative

 The victim’s sister, Kanchan, alleged that Nikki was murdered by her husband Vipin and his family over a long-standing demand for a Rs 36 lakh dowry. This account was supported by the victim’s young son, who gave a chilling eyewitness testimony.

The initial narrative was solidified by a widely circulated mobile video filmed by Kanchan, which appeared to show the family’s brutal treatment of Nikki. This led to the swift arrest of all four accused family members, including the husband, Vipin Bhati, who was arrested after a police encounter.

There are videos showing instances of prior harassment and assault for dowry. The father of the victim had alleged that her mother-in-law poured kerosene while her husband set her on fire. The National Commission for Women (NCW) has taken Suo motu cognisance of the incident demanding an action report in 3 days.

The Counter-Narrative

The emergence of new digital evidence has complicated the case. A video allegedly shows Kanchan asking her sister, “Behen, tune ye kya kar liya?” (“Sister, what have you done?”), a phrase the defense could use to argue the death was a suicide.

CCTV footage is another crucial piece of evidence. It allegedly shows Vipin Bhati outside the house at the time of the fire. This directly contradicts the child’s eyewitness testimony and casts doubt on the primary narrative.

Conflicting Motives

The victim’s family claims dowry as the motive. Neighbors and police investigators have pointed out a dispute over Nikki and Kanchan’s beauty parlor. They also noted their use of Instagram reels. Vipin reportedly felt “ridiculed” by this social media activity.

According to a report, there have been prior allegations and an old video showing the accused harassing and assaulting the victim. Nikki has been married to Vipin since 2016. She endured years of harassment. This information is per her sister Kanchan. Kanchan is married to Vipin’s brother, Rohit.

The case is now more complex because of the significant challenges of relying on digital evidence. A court will have to determine the authenticity of all videos. It must establish the timeline for them. The court will also weigh the child’s emotional testimony against the objective CCTV footage, which is yet unverified.

The FIR includes charges for murder and criminal conspiracy. It has not yet added any specific dowry harassment charge. Section 80 BNS is crucial in this case. Also, since marriage is older than 7 years, Bharatiya Sakshya Adhiniyam does not permit a presumption of dowry death.

A 2024 assault FIR against Vipin Bhati, the accused in the alleged Greater Noida dowry case, has resurfaced amid ongoing investigation over the death of his wife who allegedly was set afire by him on August 21.

The resolution of this case will be a crucial test for India’s justice system. This case has alleged motives for the crime. There is an alleged history of domestic violence. It involves a child witness. Digital evidence is found from both sides of the matter.
